Please read these terms carefully before using Octary. By accessing or using our website, you agree to be bound by these terms. If you do not agree, please do not use the service.

1. About Octary

Octary is an energy information and comparison portal. We provide tools to help UK consumers and energy professionals compare energy tariffs, understand the Ofgem price cap, and access live grid data. We operate under the trading name Octary. Our contact email is energy@octary.com.

2. Eligibility

You must be at least 18 years old and a resident of the United Kingdom to use Octary. By registering an account, you confirm that you meet these requirements.

3. Your Account

• You are responsible for keeping your login credentials secure
• You must not share your account with others
• You must provide accurate information when registering
• You must notify us immediately at energy@octary.com if you suspect unauthorised access to your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Use of the Service

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the site or its infrastructure
• Scrape, copy, or redistribute our data without written permission
• Use automated tools to make excessive requests that degrade service for other users
• Impersonate any person or entity
• Submit false, misleading, or fraudulent information
• Use the API in ways that breach the API-specific terms in Section 9

5. Tariff Comparison Information

Tariff data displayed on Octary is sourced from the Octopus Energy public API and is cached for up to six hours. We make reasonable efforts to ensure accuracy, but:

• Tariff rates can change without notice from suppliers
• The availability of tariffs may vary and is not guaranteed
• Annual cost estimates are based on UK average consumption figures from Ofgem and may not reflect your actual usage
• We are not responsible for any switching decision you make based on information shown on Octary

Always confirm current rates and terms directly with the energy supplier before entering into any supply contract.

6. AI Energy Advisor (Octavia)

Our AI chat feature, Octavia, is powered by Anthropic's Claude AI. Responses are generated automatically and:

• Are for general guidance only and do not constitute regulated financial or energy advice
• May contain errors or outdated information
• Should not be relied upon as a substitute for professional advice
• Do not take into account your full personal circumstances

We may impose rate limits on AI chat usage to ensure fair access for all users.

7. Developer API

Access to the Octary API is subject to the following additional conditions:

• API keys must not be shared publicly (e.g. in client-side code or public repositories)
• You must not exceed the request limits for your plan
• API data must not be resold or sublicensed without our written consent
• We reserve the right to suspend API access for abuse or non-payment
• We provide no uptime guarantee for the API; it is provided on a best-efforts basis

8. Intellectual Property

All content on Octary — including text, design, code, and graphics — is the property of Octary or its licensors. You may not reproduce, distribute, or create derivative works without our written permission. The underlying energy data is sourced from third-party APIs and is subject to those providers' terms.

9. Disclaimer of Warranties

Octary is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The service will be uninterrupted, error-free, or secure
• Any tariff data, price estimates, or AI responses are accurate, complete, or current
• The service will meet your specific requirements

10. Limitation of Liability

To the fullest extent permitted by law, Octary shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to losses resulting from switching energy supplier based on information shown on this site. Our total liability to you shall not exceed £100.

Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Third-Party Links and Services

Octary may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites. Links do not constitute endorsement.

12. Changes to the Service

We may modify, suspend, or discontinue any part of Octary at any time without notice. We may also update these terms — the "last updated" date will reflect changes. Continued use after a change constitutes acceptance.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
